These Terms of Service govern your access to and use of the elderly care services provided by EaseMyLife.

1. Acceptance of Terms

Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, and care recipients who access or use the Services, including any related website, mobile application, or platform.

By registering an account, booking Services, or otherwise using the Services, you represent that you are at least 18 years of age, legally competent to enter into a contract under the Indian Contract Act, 1872, and have the authority to bind any care recipient on whose behalf you act.

If you do not agree with any part of these Terms, you must not access or use the Services.

2. Service Description

EaseMyLife provides elderly care services, including but not limited to in-home caregiving, companionship, medical assistance coordination, daily living support, and related senior care solutions across India. Services are delivered by trained caregivers matched to users based on needs assessments.

We provide the Services "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted operation.

Users must provide complete medical history and pre-existing conditions during registration to ensure appropriate care matching.

3. User Responsibilities

Users include customers (family members or sponsors booking Services) and care recipients (elderly individuals receiving care). All Users agree to:

  • Provide accurate, current, and complete information during registration and update it promptly
  • Maintain confidentiality of account credentials and notify us immediately of any unauthorized use
  • Comply with all applicable Indian laws, including the Information Technology Act, 2000, and Digital Personal Data Protection Act, 2023
  • Ensure care recipients consent to Services and disclose all medical information fully
  • Not misuse the Services, impersonate others, submit false information, or engage in fraudulent activity
  • Cooperate with caregivers, follow care plans, and supervise Services as needed
  • Maintain a safe environment for caregivers and report any issues promptly

Failure to comply constitutes a material breach, potentially leading to account suspension or termination.

4. Payment Terms

Services are provided on a subscription basis or as per agreed packages, with fees specified during booking. Payments are processed via secure methods (e.g., online gateways, UPI).

  • Payments are due on the scheduled date; late payments incur a fee of ₹100 per day
  • We reserve the right to revise fees annually with 60 days' prior written notice
  • Subscriptions auto-renew unless cancelled; additional hours or services may incur extra charges
  • All fees exclude taxes, which Users must pay as applicable

Users authorize recurring payments and agree to pay all amounts owed.

5. Cancellation & Refunds

User Cancellation

Subscriptions or bookings may be cancelled with notice as per the plan (e.g., 30 days for monthly plans). No refunds for partial periods unless specified.

Service Cancellation

We may cancel Services for breach of Terms, non-payment, or safety reasons, with pro-rata refunds where applicable.

Refund Processing

Refunds, if any, are processed within 15-30 days to the original payment method, minus processing fees. No refunds for no-shows or after Services commence.

All cancellations must be in writing via the platform or designated support.

6. Limitation of Liability

To the maximum extent permitted by law, the Company, its affiliates, caregivers, and providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the Services, including but not limited to loss of data, injury, or death, even if advised of the possibility.

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We disclaim all warranties, express or implied, and make no representations that Services will meet your requirements, be uninterrupted, or error-free.

Users assume all risks associated with care decisions and outcomes. Caregivers are independent contractors; we are not responsible for their actions beyond matching and oversight.

7. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the competent courts in India. Users submit to the non-exclusive jurisdiction of such courts.

8. Changes to Terms

We may update these Terms at any time. Changes will be posted on our platform with the effective date and notice where required by law. Your continued use of the Services after changes constitutes acceptance.

We recommend reviewing Terms periodically. The latest version governs your use.
